Terms and Conditions for Hook•n•Noodle
In these Terms and Conditions, the user of the Website is referred to as "you" or "your" and the provider of website is referred to as “Hook•n•Noodle”, “www.hooknnoodle.com", "we", "us" or "our".
1. Acceptance of Terms
By accessing and using www.hooknnoodle.com and the services provided by Hook•n•Noodle, you agree to comply with and be bound by these Terms of Use. These Terms of Use apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. If you do not agree with any part of these terms, you may not use our website and services.
2. Product Information
We make every effort to display the most recent, most accurate, and most reliable product information on our website at all times, including but not limited to pricing, availability, physical features and discounts. Please note that we present our content 'as is' and make no claims to its accuracy, either expressed or implied. Measurements/dimensions of the products are approximate only to allow you to understand the approximate size of the product. When a product featured on www.hooknnoodle.com is no longer in stock, we make every attempt to remove that item from the website in a timely manner.
In the event a product at www.hooknnoodle.com is listed with an incorrect price/availability information due to photographical error, typographical error or backend error in updating information, Hook•n•Noodle shall have the right to refuse or cancel orders placed for such products. Errors like incomplete data, typographical errors and/or other inaccuracies are wholly unintentional and we apologise if the erroneous information affects your individual order in any way. We reserve the right to modify or update this information at any time without prior notice.
3. Placing Orders
Placing an order on our website constitutes an offer to purchase our products. We reserve the right to accept or decline any order for any reason. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or phone number provided at the time the order was made. You agree to provide current, complete and accurate purchase and account information for any/all purchases made at our store.
4. Shipping and Delivery
At Hook•n•Noodle, we are committed to delivering the order placed by you within the given period and in accordance with the terms stated in "Shipping and Delivery".
We offer free shipping in India for orders above Rs.1099 (use the discount code sent in email sign-up while checking out). For orders below Rs.1099, the shipping charges are Rs. 80/-. For bulk orders, the shipping charges are as per weight.
The products at our store are made-to-order and are processed and shipped in 4-12 business days. Depending on the delivery location, orders take 1-5 days after that to reach you. So you can expect a delivery between 5-17 days. We offer Express Delivery for Rs. 299 shipping and priority production cost. We only make use of reliable courier companies like Shiprocket, DTDC, The Professional Courier and TrackOn Courier. Hook•n•Noodle is not liable for any delays in delivery by the Courier Company or on account of any factors beyond the our control.
You will get a Tracking Number along with the courier company's tracking link in your inbox as soon as your order is dispatched. You can track the location of your order on the link without any hassle.
In the unlikely event that delivery is not possible for any reasons outside the control of Hook•n•Noodle, including but not limited to poor courier services in delivery area, inaccessibility of delivery area, force majeure events, we shall inform you of such inability to deliver and cancel your order, followed by a refund for the products ordered after we receive them. In the case of an unsuccessful delivery followed by an RTO initiation after 3 attempts at contacting the customer, the following process will be followed as per the customer's decision: We may levy a repeat shipping charge and ship the order again after we receive it OR we may cancel the order and initiate a refund (minus the shipping costs) after we receive the product in it's original condition.
Kindly ensure that all information that is submitted by you to us on the platform is true, complete, accurate and sufficient to identify the actual place of delivery. If you have entered the wrong shipping information or contact details, it might cause a delay or missed delivery and customer will have to bear additional shipping cost. If you need to make any changes to your delivery address or any other contact details, please notify us within 24 hours of placing your order (not applicable for urgent orders).
We aim to deliver products within the estimated delivery time provided. However, we are not responsible for delays beyond our control.
5. Returns / Replacement / Refunds
Since our products are handmade and made-to-order, returns for reasons other than damage and incorrect products are not applicable. If the package seems to be damaged or tempered with before the delivery, kindly refuse to accept the package and send us a photographic proof of damage along with your Order Number at care@hooknnoodle.com to initiate the replacement/refund process.
If you have received a damaged/incorrect product, drop us a mail at care@hooknnoodle.com with an unboxing video of the damaged/incorrect product within 2 days of receiving the order. We will check and get back to you with whether we can replace the product (based on availability) or refund your money.
Refunds/Replacements will only be initiated once we have received, thoroughly checked and approved your claim of the damaged/incorrect product.
Please note that refund will only be issued for the products and will not include the shipping charges. In the case of return or replacement, the shipping cost for returning the product shall be borne by the customer.

7. Care Instructions:
If the product is damaged or affected in any way on account of improper, reckless use, disregard of care instructions provided, we assume no liability for the damage or any shortcomings in the make or quality of the product. Handmade items are delicate and must be handled with care.
8. User Submissions
By submitting any content to Hook•n•Noodle (e.g., comments, reviews, ideas), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content worldwide in any media. Hook•n•Noodle is not obligated to maintain confidentiality, compensate for, or respond to any submissions. We may monitor, edit, or remove content at our sole discretion. We are not liable for any user-generated content or any damages resulting from such content.
9. Intellectual Property
All content on www.hooknnkoodle.com and our social media accounts, including but not limited to products, logos, images, and text, is the created and owned by Hook•n•Noodle. Any unauthorized use, reproduction, or distribution of this content, in whole or in part, is strictly prohibited and may result in legal action.
10. Limitation of Liability
Hook•n•Noodle makes no warranty regarding the uninterrupted, error-free, or virus-free operation of this website. Users assume all risks and costs associated with accessing and using this website.
To the extent permitted by law, Hook•n•Noodle shall not be liable for any damages arising from the use or inability to use this website or our products/services; any errors or omissions in the website content; any viruses or other harmful elements on this website or server; any reliance on information provided on this website.
This limitation of liability applies to all damages, including direct, indirect, incidental, consequential, or punitive damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless Hook•n•Noodle, its affiliates, parent companies, subsidiaries, partners, officers, directors, employees, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and any other related parties from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to your use of this website, our products, or our services; your breach of these Terms of Service or any documents they incorporate by reference; your violation of any applicable law or the rights of any third party; or any activity related to your account, whether by you or any other person accessing the site using your account, including negligent or wrongful conduct.

These Policies are governed by and construed in accordance with the laws of India. Any dispute arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in New Delhi.
